Plain English summary: Use Embroxia fairly and legally. You own your designs. We own the platform. Don't abuse the service. We can terminate accounts that violate these terms.
1. Acceptance of terms
By accessing or using Embroxia ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including visitors, registered users, and paying subscribers.
2. Description of service
Embroxia is a browser-based embroidery design platform that provides digitizing tools, AI-powered design assistance, file export capabilities, and a design marketplace. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time.
3. Your account
- You are responsible for maintaining the security of your account credentials
- You must provide accurate information when creating an account
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use of your account
- One person or entity may not maintain more than one free account
4. Intellectual property
Your designs
You retain full ownership of all embroidery designs you create using Embroxia. By using the Service, you grant Embroxia a limited, non-exclusive licence to store and display your designs solely for the purpose of providing the Service to you.
Our platform
Embroxia, its logo, software, tools, and all associated intellectual property are owned by Embroxia and protected by copyright law. You may not copy, modify, distribute, or reverse engineer any part of the platform.
Marketplace designs
When you purchase a design from the Embroxia Marketplace, you receive a licence to use that design for commercial embroidery production. You may not resell, redistribute, or claim ownership of purchased designs.
5. Acceptable use
You agree not to use Embroxia to:
- Create designs that infringe on third-party intellectual property or trademarks
- Upload malicious files or attempt to compromise the platform's security
- Attempt to gain unauthorised access to other users' accounts or data
- Use the AI features to generate harmful, illegal, or offensive content
- Scrape, crawl, or systematically extract data from the platform
- Resell or sublicence access to the Service without our written permission
- Use the Service for any illegal purpose
6. Subscriptions and payments
- Paid subscriptions are billed in advance on a monthly or annual basis
- Payments are processed by Lemon Squeezy. By subscribing, you also agree to their terms
- Free trials automatically convert to paid subscriptions unless cancelled before the trial ends
- We do not offer refunds for partial months of service
- We reserve the right to change pricing with 30 days notice to existing subscribers
7. Cancellation
You may cancel your subscription at any time through your Lemon Squeezy billing portal or by emailing us. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.
8. Limitation of liability
To the maximum extent permitted by law, Embroxia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising out of these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Disclaimers
The Service is provided "as is" without warranty of any kind. We do not guarantee that exported files will be compatible with all embroidery machines, or that AI-generated designs will be production-ready without human review. Always test designs before commercial production.
10. Termination
We may terminate or suspend your account immediately, without notice, if you violate these terms. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.
11. Governing law
These terms are governed by applicable international law. Any disputes will be resolved through binding arbitration or in a court of competent jurisdiction.
12. Changes to terms
We may update these terms at any time. Significant changes will be communicated to registered users via email with at least 14 days notice. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
